HUN-REN-ELTE LEGAL HISTORY RESEARCH GROUP – THE DIMENSIONS OF SOVEREIGNTY IN THE 19TH AND 20TH CENTURY HUNGARIAN LEGAL DEVELOPMENT

The central element of the HUN-REN-ELTE Legal History Research Group concept is the assessment of the Hungarian law-making, law-applying and jurisprudential sovereignty within the context of the continent’s development, when Hungary was looking for its constitutional placement within the framework of the 19th century Habsburg Empire and the Austro-Hungarian Monarchy. Based on the call, the goal of the project is to create and support scientific salons led by successful academics, who work in higher educational institutions or public collections or institutions, which conduct research. Similarly, the project is aimed at enhancing the supply of future researchers and lecturers (by giving privileges to the support of young academics), as well as at strengthening the cooperation between the Hungarian National Academy’s [as of 1 September 2019: the Eötvös Loránd Research Network's (ELKH)] research institution network and the higher educational institutions. Those topics and their study, which are missing from the research institution network’s profile or expanding upon that while providing novelty in the Hungarian academic world, be they in any scientific field and especially in exploratory research deserve assistance. 

The sovereignty of law has been guaranteed or limited by state structures and by those interactions that existed between the Hungarian legal practice and jurisprudence on the one hand and the center of Europe on the other hand. The systematic functioning of the law was determined by the Austrian and dynastic interests, which could limit the free forming of the law on the legislative level. The politics of the European superpowers, the current forming, reforming, and changing of alliances could negatively impact the free exercise of will along varying economic interests. The Hungarian legal society, which looked towards the West with its aim at modernization, adjusted its renewal of the codification to the forms established in the center of Europe. The research on the one hand examines the extent to which the19th-20th century Hungarian development was dependent on the center of Europe, or on the smaller, regional frame, (a special characteristic), the Austro-Hungarian Monarchy’s system. To what extent could the Hungarian constitutional continuity and public legal traditionalism counterbalance the determining effects and to what degree and how did it adapt to the expectations that derived from the required integration. On the other hand, the research plans to examine the reaction to the harmonizing demands derived from the jurisprudence of the border nation in such significant areas as the codification, the nationality and minority rights, the freedom of the press and the rights of citizens, as well as the modernization of the public administration. 

The aim of the MTA-ELTE Research Group is focusing on the Hungarian legal historic research, while organizing scientific conferences, editing publication series, and fostering informal connections. The Research Group publishes the results of its work in journals (first and foremost in the Journal of Legal History / Jogtörténeti Szemle) and individual books. Its regularly published series are the Ungarische Rechtshistoriker in German and the Rechtsgeschichtliche Vorträge/Lectures on Legal History in German and English.

HUN-REN-ELTE RECHTSHISTORISCHE FORSCHUNGSGRUPPE – DIE DIMENSIONEN DER SOUVERÄNITÄT IN DER UNGARISCHEN RECHTSENTWICKLUNG DES 19. UND 20. JAHRHUNDERTS

Zentrales Element des Konzepts der HUN-REN-ELTE Rechtshistorische Forschungsgruppe  ist die Beurteilung der ungarischen rechtssetzenden, rechtsanwendenden und rechtswissenschaftlichen Souveränität im Kontext der Entwicklung des Kontinents, als Ungarn seine verfassungsrechtliche Einordnung im Rahmen des Habsburgerreiches und der Österreichisch-Ungarischen Monarchie des 19. Jahrhunderts suchte. Das Ziel des Projekts ist es, auf der Grundlage des Aufrufs wissenschaftliche Salons zu schaffen und zu unterstützen, die von erfolgreichen Wissenschaftlern geleitet werden, die im Hochschulwesen oder öffentlichen Sammlungen oder Einrichtungen arbeiten und die Forschung betreiben. Ebenso zielt das Projekt darauf ab, das Angebot für zukünftige Forscher und Dozenten zu verbessern (indem die Förderung junger Nachwuchswissenschaftler und Nachwuchswissenschaftlerinnen unterstützt wird), sowie die Zusammenarbeit zwischen dem Netzwerk der Forschungseinrichtungen der der Ungarischen Akademie der Wissenschaften [seit 1 September 2019: des Eötvös Loránd Forschungsnetzes (ELKH)] und die Hochschulen zu stärken. Die Themen und deren Erforschung, die im Profil des Forschungsinstitutionennetzes fehlen bzw. dieses erweitern und gleichzeitig eine Neuheit in der ungarischen akademischen Welt darstellen, sei es in irgendeinem wissenschaftlichen Bereich und insbesondere in der erkundigende/aufdeckende Forschung, verdienen Unterstützung. 

Die Souveränität des Rechts wurde durch die staatlichen Strukturen und durch jene Wechselwirkungen, die zwischen der ungarischen Rechtspraxis und Rechtswissenschaft einerseits und dem Zentrum Europas andererseits bestanden, ermöglicht oder eingeschränkt. Das systematische Funktionieren des Rechts wurde von den österreichischen und dynastischen Interessen bestimmt, die die freie Gestaltung des Rechts auf der legislativen Ebene einschränken konnten. Die Politik der europäischen Großmächte, die laufende Bildung, Reformierung und Änderung von Bündnissen konnte die freie Willensausübung entlang unterschiedlicher wirtschaftlicher Interessen negativ beeinflussen. Die ungarische Rechtsgesellschaft, die mit dem Ziel der Modernisierung nach Westen schaute, passte ihre Erneuerung der Kodifizierung an die im Zentrum Europas etablierten Formen an. Die Untersuchung geht einerseits der Frage nach, inwieweit die ungarische Entwicklung des 19. und 20. Jahrhunderts vom Zentrum Europas oder vom kleineren, regionalen Rahmen (eine Besonderheit), dem System der Österreichisch-Ungarischen Monarchie, abhängig war. Inwieweit konnte die ungarische Verfassungskontinuität und der öffentlich-rechtliche Traditionalismus die bestimmenden Effekte ausgleichen und inwieweit passte sie sich den Erwartungen an, die sich aus der geforderten Integration ergaben? Zum anderen soll die Reaktion, auf die aus der Rechtsprechung der Grenznation abgeleiteten harmonisierenden Ansprüche in so bedeutenden Bereichen wie der Kodifizierung, dem Nationalitäten- und Minderheitenrecht, der Pressefreiheit und den Bürgerrechten sowie der Modernisierung der öffentlichen Verwaltung untersucht werden. 

Das Ziel der MTA-ELTE Forschungsgruppe ist die Fokussierung auf die ungarische rechtshistorische Forschung, wobei sie wissenschaftliche Konferenzen organisiert, Publikationsreihen herausgibt und informelle Verbindungen pflegt. Die Forschungsgruppe publiziert die Ergebnisse ihrer Arbeit in Zeitschriften (in erster Linie in der Zeitschrift für Rechtsgeschichte / Jogtörténeti Szemle) und in einzelnen Büchern. Die regelmäßig erscheinenden Reihen sind die Ungarische Rechtshistoriker in deutscher Sprache und die Rechtsgeschichtlichen Vorträge / Lectures on Legal History in deutscher und englischer Sprache.
